- You agree that School Perks has limited liability to the extent permitted by Australian consumer law.
- Acceptance of Terms
- These terms and conditions govern the provision and/or use of any goods and/or services provided by School Perks Pty Ltd (ACN: 674 849 042).
- Any use of the website, app, or purchase of School Perks services constitutes acceptance of these terms.
- Amendments to these Terms and Conditions take effect when updated on the website/application.
- Privacy
- School Perks is bound by and operates under the Privacy Act 1988 (Cth).
- Its Privacy Policy is published on its website and application.
- By agreeing to these Terms, you also agree to the collection and use of your information in accordance with the Privacy Policy.
- Goods and Services
- School Perks is a subscription-based program offering discounts, rewards, and promotional entries.
- Different membership tiers may apply with varying benefits and fees.
- Promotional membership periods may apply, after which standard billing resumes unless cancelled.
- Rewards and discounts by third parties may have additional terms set by those parties.
- Membership is open only to Australian residents aged 18 years or older.
- School Perks may change, limit, or discontinue any goods or services at its discretion.
- School Perks reserves the right to:
- add, remove, vary, substitute, or discontinue goods or services; and
- refuse, suspend or vary memberships.
- Promotions will follow these Terms and any additional conditions for that promotion.
- By subscribing, you warrant that you meet eligibility criteria and accept these Terms.
- Terms of Use
- When registering, you may be asked to provide personal information (“User Information”).
- You may not hold more than one membership per person.
- You agree that:
- all information you provide is true and complete;
- you are the individual identified in any registration process;
- you are an authorised user of any registered payment card;
- failure to provide true information breaches these Terms; and
- you will promptly update your User Information if it changes.
- Failure to update information may result in suspension or termination of your account.
- Memberships are personal and non-transferable.
- You must notify School Perks immediately of any unauthorised account access.
- School Perks may restrict or terminate membership if these Terms are breached.
- Purchases and memberships are non-refundable except where required by law.
- In using any School Perks services, you must not:
- violate any laws or infringe on others’ rights;
- engage in defamatory or harmful conduct; or
- participate in security breaches or misuse of private information.
- All communications submitted to School Perks become its exclusive property.
- You are responsible for any violations and indemnify School Perks for resulting loss or damage.
- School Perks makes no warranties regarding any third-party products or services featured on its platform.
- Termination of Membership
- You may cancel membership anytime by notice in writing or through the website/app.
- Cancellation does not release you from fees owed.
- Upon cancellation, you are no longer eligible to:
- access member-only content or rewards;
- be entered into Promotions; or
- receive prizes from closed Promotions not yet distributed.
- Consumer Rights & Obligations
- Australian Consumer Law applies and cannot be excluded.
- For minor problems, School Perks may repair, replace, or refund at its discretion.
- For major problems, consumers can request a full refund or compensation.
- Promotions
- Promotions may be conducted from time to time in accordance with these Terms.
- Each Promotion will specify prize details, dates, conditions, and eligibility requirements.
- Unless otherwise specified, Promotions are open to Australian residents aged 18+ who are members.
- By subscribing, you agree to automatic entry into any active Promotions during membership.
- How to Enter Promotions
- Promotions are entered automatically for all members.
- Entry counts depend on membership tier and participation.
- Additional entries may be earned through Program activity or special campaigns.
- Entries are non-transferable and not redeemable for cash.
- No entry fee is required.
- Winners’ information may be published as required by law.
- Prizes
- Prizes are as stated in each Promotion listing.
- Cancelled members forfeit unclaimed prizes.
- Substitute prizes may be provided if unavailable.
- Prize records are kept for 3 years as per regulations.
- Drawing
- Draws occur on the published date using a random system.
- Draw methods may vary but must ensure fairness.
- School Perks may modify draw procedures if required by law.
- How to Claim a Prize
- Winners will be notified via their registered User Information.
- Winner details may be published as required by law.
- Proof of eligibility may be requested.
- Failure to respond or provide proof may result in forfeiture.
- No administrative fees will be charged to receive prizes.
- Authorisation
- School Perks is authorised to conduct Promotions in accordance with Victorian and other state laws.
- The Program Terms
- The Program allows members to earn rewards and discounts when using registered payment cards with participating merchants.
- Registering for the Program:
- Be a subscribed member;
- Provide required User Information;
- Register a valid payment card;
- Be the authorised cardholder; and
- Complete registration properly.
- Special conditions of use:
- Make purchases with participating merchants using your registered card;
- Use the “credit” (CR) option for EFTPOS transactions;
- Only registered cards earn rewards;
- Keep tax receipts as proof of purchase.
- Participating Merchants: Only merchants listed on the School Perks website qualify.
- Fees and Charges: Merchant or delivery fees may apply; School Perks makes no warranty regarding these.
- Receiving Rewards: Rewards are personal, non-transferable, and subject to transaction validity and merchant criteria.
- Refunds or Returns: Refunds trigger reversal of earned rewards. Reversed amounts may become a debt if cash rewards have been paid out.
- Indemnity
- You indemnify School Perks against all losses or claims arising from:
- your breach of these Terms;
- your use of the Program;
- any unauthorised use of your account; or
- any claims linked to your User Information.
- Exclusions and Liability
- Nothing limits statutory consumer guarantees under Australian law.
- Except where not permitted by law, School Perks excludes liability for losses or damages arising from:
- technical issues or theft;
- unauthorised access or interference;
- changes or removal of services;
- late or lost entries;
- network or transmission failures;
- damaged prizes or variation in prize value;
- any taxes or third-party charges.
- In cases beyond School Perks’ control, Promotions may be varied, cancelled, or rescheduled under applicable law.
- Headings
- Headings are for convenience only and do not affect interpretation.
- Force Majeure
- School Perks is not liable for failure to perform obligations caused by events beyond its control.
- Jurisdiction and Law
- These Terms are governed by the laws of Victoria, Australia.
- Severability
- Each provision is independent; invalid provisions do not affect the remainder.
