  1. Summary
    1. These terms and conditions apply to the provision and use of School Perks goods and/or services, including entry into promotions.
    2. Key obligations that you agree to when you use School Perks goods and/or services include:
      1. You accept these terms and conditions, and the School Perks privacy policy;
      2. You meet the relevant eligibility criteria for subscription to School Perks, and entry into any promotions.
      3. You will not hold multiple accounts.
      4. You will keep your contact information up to date.
      5. You will only provide information and content that you have the right to share.
      6. You will comply with the law, and indemnify School Perks for any loss or damage arising out of any violation or breach of these terms and conditions.
      7. You are okay with us providing notices and messages to you through our website and app, using contact information you provided to us.
      8. You will honour your payment obligations in respect of any paid services, and you are okay with us storing your payment information.
      9. You agree that School Perks has limited liability to the extent permitted by Australian consumer law.
  2. Acceptance of Terms
    1. These terms and conditions govern the provision and/or use of any goods and/or services provided by School Perks Pty Ltd (ACN: 674 849 042).
    2. Any use of the website, app, or purchase of School Perks services constitutes acceptance of these terms.
    3. Amendments to these Terms and Conditions take effect when updated on the website/application.
  3. Privacy
    1. School Perks is bound by and operates under the Privacy Act 1988 (Cth).
    2. Its Privacy Policy is published on its website and application.
    3. By agreeing to these Terms, you also agree to the collection and use of your information in accordance with the Privacy Policy.
  4. Goods and Services
    1. School Perks is a subscription-based program offering discounts, rewards, and promotional entries.
    2. Different membership tiers may apply with varying benefits and fees.
    3. Promotional membership periods may apply, after which standard billing resumes unless cancelled.
    4. Rewards and discounts by third parties may have additional terms set by those parties.
    5. Membership is open only to Australian residents aged 18 years or older.
    6. School Perks may change, limit, or discontinue any goods or services at its discretion.
    7. School Perks reserves the right to:
      1. add, remove, vary, substitute, or discontinue goods or services; and
      2. refuse, suspend or vary memberships.
    8. Promotions will follow these Terms and any additional conditions for that promotion.
    9. By subscribing, you warrant that you meet eligibility criteria and accept these Terms.
  5. Terms of Use
    1. When registering, you may be asked to provide personal information (“User Information”).
    2. You may not hold more than one membership per person.
    3. You agree that:
      1. all information you provide is true and complete;
      2. you are the individual identified in any registration process;
      3. you are an authorised user of any registered payment card;
      4. failure to provide true information breaches these Terms; and
      5. you will promptly update your User Information if it changes.
    4. Failure to update information may result in suspension or termination of your account.
    5. Memberships are personal and non-transferable.
    6. You must notify School Perks immediately of any unauthorised account access.
    7. School Perks may restrict or terminate membership if these Terms are breached.
    8. Purchases and memberships are non-refundable except where required by law.
    9. In using any School Perks services, you must not:
      1. violate any laws or infringe on others’ rights;
      2. engage in defamatory or harmful conduct; or
      3. participate in security breaches or misuse of private information.
    10. All communications submitted to School Perks become its exclusive property.
    11. You are responsible for any violations and indemnify School Perks for resulting loss or damage.
    12. School Perks makes no warranties regarding any third-party products or services featured on its platform.
  6. Termination of Membership
    1. You may cancel membership anytime by notice in writing or through the website/app.
    2. Cancellation does not release you from fees owed.
    3. Upon cancellation, you are no longer eligible to:
      1. access member-only content or rewards;
      2. be entered into Promotions; or
      3. receive prizes from closed Promotions not yet distributed.
  7. Consumer Rights & Obligations
    1. Australian Consumer Law applies and cannot be excluded.
    2. For minor problems, School Perks may repair, replace, or refund at its discretion.
    3. For major problems, consumers can request a full refund or compensation.
  8. Promotions
    1. Promotions may be conducted from time to time in accordance with these Terms.
    2. Each Promotion will specify prize details, dates, conditions, and eligibility requirements.
    3. Unless otherwise specified, Promotions are open to Australian residents aged 18+ who are members.
    4. By subscribing, you agree to automatic entry into any active Promotions during membership.
  9. How to Enter Promotions
    1. Promotions are entered automatically for all members.
    2. Entry counts depend on membership tier and participation.
    3. Additional entries may be earned through Program activity or special campaigns.
    4. Entries are non-transferable and not redeemable for cash.
    5. No entry fee is required.
    6. Winners’ information may be published as required by law.
  10. Prizes
    1. Prizes are as stated in each Promotion listing.
    2. Cancelled members forfeit unclaimed prizes.
    3. Substitute prizes may be provided if unavailable.
    4. Prize records are kept for 3 years as per regulations.
  11. Drawing
    1. Draws occur on the published date using a random system.
    2. Draw methods may vary but must ensure fairness.
    3. School Perks may modify draw procedures if required by law.
  12. How to Claim a Prize
    1. Winners will be notified via their registered User Information.
    2. Winner details may be published as required by law.
    3. Proof of eligibility may be requested.
    4. Failure to respond or provide proof may result in forfeiture.
    5. No administrative fees will be charged to receive prizes.
  13. Authorisation
    1. School Perks is authorised to conduct Promotions in accordance with Victorian and other state laws.
  14. The Program Terms
    1. The Program allows members to earn rewards and discounts when using registered payment cards with participating merchants.
    2. Registering for the Program:
      1. Be a subscribed member;
      2. Provide required User Information;
      3. Register a valid payment card;
      4. Be the authorised cardholder; and
      5. Complete registration properly.
    3. Special conditions of use:
      1. Make purchases with participating merchants using your registered card;
      2. Use the “credit” (CR) option for EFTPOS transactions;
      3. Only registered cards earn rewards;
      4. Keep tax receipts as proof of purchase.
    4. Participating Merchants: Only merchants listed on the School Perks website qualify.
    5. Fees and Charges: Merchant or delivery fees may apply; School Perks makes no warranty regarding these.
    6. Receiving Rewards: Rewards are personal, non-transferable, and subject to transaction validity and merchant criteria.
    7. Refunds or Returns: Refunds trigger reversal of earned rewards. Reversed amounts may become a debt if cash rewards have been paid out.
  15. Indemnity
    1. You indemnify School Perks against all losses or claims arising from:
      1. your breach of these Terms;
      2. your use of the Program;
      3. any unauthorised use of your account; or
      4. any claims linked to your User Information.
  16. Exclusions and Liability
    1. Nothing limits statutory consumer guarantees under Australian law.
    2. Except where not permitted by law, School Perks excludes liability for losses or damages arising from:
      1. technical issues or theft;
      2. unauthorised access or interference;
      3. changes or removal of services;
      4. late or lost entries;
      5. network or transmission failures;
      6. damaged prizes or variation in prize value;
      7. any taxes or third-party charges.
    3. In cases beyond School Perks’ control, Promotions may be varied, cancelled, or rescheduled under applicable law.
  17. Headings
    1. Headings are for convenience only and do not affect interpretation.
  18. Force Majeure
    1. School Perks is not liable for failure to perform obligations caused by events beyond its control.
  19. Jurisdiction and Law
    1. These Terms are governed by the laws of Victoria, Australia.
  20. Severability
    1. Each provision is independent; invalid provisions do not affect the remainder.
